Terms of Service

These terms are between you and Gwei Labs Pty Ltd (ABN 98 656 175 174), 470 St Kilda Road, Melbourne VIC 3004, Australia, not Apple. By opening the door (creating an account or signing in) you agree to them and to the Privacy Policy.

1 · The deal

Sparefilm is free. One roll of film a day, six frames, shot blind; it develops at eight in the evening, wherever you are, and goes uncut to the people you let in. No ads, no boosts, nothing to buy.

2 · Who can join

Sixteen and older, by invitation. You give us a truthful date of birth once, at the door; under sixteen we refuse the account and store no account, no name, no date of birth: one scrambled record of the refused address remains for thirty days (Privacy Policy §10). Your date of birth stays on your device. One account per person. If we learn an account belongs to someone under sixteen, it closes. Before launch, when you send the waitlist form on the website, Google (reCAPTCHA Enterprise) checks that a person sent it and not a machine; it runs on the website only, never in the app, and only on that press (Privacy Policy §7).

3 · Your account

Your handle is yours while the account lives: three characters or more, unique, not on the reserved list. You can change it; your signature changes with it, and the released handle is quarantined for 30 days so an old invite link never points at a stranger. Your darkroom opens only to the sign-ins you have linked. Link a second, because one can be lost and two cannot; we hold no copy and cannot open it for you. Lose every key and the darkroom is gone for good. You're responsible for what happens under your key until you tell us it's stolen.

4 · Your work stays yours

Your photographs, notes, and marks are yours. You give us only the licence the product needs: non-exclusive, worldwide, royalty-free: to host and store your work, show it to your followers and to anyone holding a share link you made, and process it to run the service (developing, thumbnails, and the safety scan, Policy §14). The licence ends when you destroy the work or delete the account, except that we may keep what the law requires us to keep. We don't put your work in ads and we don't train models on it.

5 · The rules of the room

Shoot your own day. Don't post: anything unlawful; other people's private moments taken or shared without their leave (you're responsible for the people in your frames: a photograph of someone is their day too); child sexual abuse material (zero tolerance, reported to authorities); credible threats; other people's work passed off as your frames.

Reports go to human review, and the develop-window safety scan can hold a frame for one (Policy §14). If a frame comes down, you're told what came down and why, and the sleeve stays in your Binder, marked: nothing vanishes silently. If a frame of yours comes down and you think we got it wrong, you can appeal: write to appeals@sparefilm.app and we answer within five business days. Blocking hides you both going forward, ends the follow, and deletes nothing.

6 · Marks

A mark is a signed vouch: it carries your name because an unsigned one is meaningless. Marks you left are removed if you delete your account.

7 · Invites

Invitations are not rationed by count. They are rate-limited so that no single account can mint them in bulk, and the limit clears on its own. Your invite link carries your handle: handing it out tells people it's from you. When someone arrives on your invite, you follow each other. You vouch for who you let in; invite abuse (spam, selling entry) is a rules breach.

8 · The hour

Rolls develop at eight in the evening, local to you. It is not adjustable. That's the product, not a defect. We may change how Sparefilm works; if a change is material we'll tell you in the app before it lands.

9 · Withdraw and destroy

Withdrawing a roll takes it out of Daylight and kills its share link. Destroying negatives deletes every frame, the note, and every vouch at once, never to be restored: we keep no backups and no point-in-time recovery, and could not bring them back if we wanted to.

10 · Ending it

You can delete your account in Settings, in the app; the deletion cascade is described in the Privacy Policy §9. We can suspend or close an account that breaks §2 or §5; we'll say which rule and, where the law allows, show what triggered it. We can wind down Sparefilm itself with 60 days' notice and your work available (in-app sheet export, or everything by request) until the end.

11 · Australian Consumer Law

Nothing in these terms excludes, restricts, or modifies any consumer guarantee or right that the law where you live does not let us exclude: in Australia the ACL, and its cousins where Sparefilm is available. Beyond those non-excludable rights, and to the extent the law permits, Sparefilm is provided as-is and our liability is limited to resupplying the service.

12 · Apple

Your licence to the app binary itself is Apple's standard Licensed Application End User License Agreement (apple.com/legal, the default that applies where no custom EULA is supplied). These Terms govern the service; the standard EULA governs the binary; where they conflict about the binary, the EULA wins. Apple has no obligation to maintain or support the app, isn't responsible for the service or its content, and is a third-party beneficiary of this section.

13 · Governing law

These terms are governed by the laws of Victoria, Australia, and disputes belong to its courts, without displacing consumer protections that apply where you live.

14 · Changes to these terms

We'll tell you in the app before new terms take effect; the date at the top says which version you agreed to. Continuing past the date is acceptance.
